1) Revocation; 2) Effective December 28, 1993. Respondent failed to answer the formal complaints and failed to appear at the hearing held in Farmington Hills on August 24, 1993. Respondent's default was entered, and the panel determined that the default established the allegations of Formal Complaint 93-107-GA. Formal Complaint 93-152-FA was dismissed.
Respondent was retained to represent a client in a probate matter and a divorce action. Respondent was subsequently discharged, and the client requested that respondent surrender all records and property to which she was entitled. Respondent failed and/or neglected to deliver the files and records; and failed to answer the request for investigation.
Respondent was retained to represent a client in a workers' disability claim, but failed to perform any services on his client's behalf resulting in his discharge; subsequent to his discharge, he failed and/or neglected to preserve and deliver, upon demand, the files and property to which his former client was entitled; and failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.15(b); 1.16(d); 8.1(b); and 8.4(a)-(c); and Canons 1, 6, and 7 of the then applicable Code of Professional Responsibility, DR 1-102(A)(1),(5) and(6); DR 6-101(A)(3); and DR 7-101(A)(1)-(3).
Costs were assessed in the amount of $130.53. NOTE: Respondent's license to practice law in Michigan has been suspended since June 18, 1993.
