1) Suspension - 45 days; 2) Effective November 26, 1993. Respondent was retained to prepare a will and power of attorney. The client died approximately one week later, and respondent commenced independent probate proceedings on behalf of the estate. The hearing panel found that respondent failed to file an inventory for the estate; abandoned the representation; and failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 8.1(b); and 8.4(a)and(c).
Costs were assessed in the amount of $400.85. NOTE: Respondent has been continuously suspended from the practice of law in Michigan since April 28, 1993.
