NOTICE OF REPRIMAND Case No. 92-112-GA William F. Klintworth, P-30993, Traverse City, Michigan, by the Attorney Discipline Board vacating a hearing panel order of dismissal.

1) Reprimand; 2) Effective October 13, 1993. In January, 1991, respondent was convicted of one count of wilful failure to file income tax return in violation of 26 USC 7206. That conviction resulted in the suspension of respondent's license to practice law in Michigan for 45 days effective September 14, 1991. (See Notice of Suspension dated September 18, 1991.) The formal complaint filed in this matter charged that respondent engaged in further professional misconduct by violating the order of probation imposed by the U.S. District Court at the time of his sentencing.

The Grand Traverse County Hearing Panel dismissed the formal complaint, although respondent admitted that the allegations in the formal complaint were generally true and that he had violated the conditions of the probation order.

The Grievance Administrator filed a petition for review seeking reversal of the hearing panel order of dismissal. In an order and opinion issued August 11, 1993, the Attorney Discipline Board vacated the order of dismissal and imposed a reprimand, concluding that the Grievance Administrator had introduced sufficient evidence to support a finding of professional misconduct.

The respondent filed a motion for reconsideration, which was denied by the Board in an order entered September 21, 1993. Costs were assessed in the amount of $538.65.
