NOTICE OF REPRIMAND WITH CONDITIONS Case Nos. 93-79-GA; 93-91-FA Stephen C. Moultrup, P-38069, Clarkston, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #57.
1) Reprimand; 2) Effective October 12, 1993. Respondent failed to answer the formal complaint but appeared at the hearing held in Commerce Township on July 8, 1993. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaint.
Respondent was retained in a bankruptcy matter, but failed to file a bankruptcy petition for over six months; failed to submit a declaration for statement of financial affairs on his client's behalf; failed to comply with the orders of the court resulting in dismissal of the bankruptcy petition; failed to keep in reasonable communication with his client; and, failed to refund unearned fees.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.15(b); 1.16(d); 3.2; 3.4(c); and 8.4(a)and(c).
The panel ordered that respondent be reprimanded, conditioned on restitution to the complainant in the amount of $435.50 and monitoring of his office procedures and management for one year. Costs were assessed in the amount of $184.52.
