NOTICE OF SUSPENSION WITH CONDITIONS Case No. 92-136-GA June A. Porter, P-30589, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #19.

1) Suspension - 30 days; 2) Effective September 14, 1993. Respondent was retained to secure unclaimed escheated escrow funds from the State of Michigan Treasury Department. Respondent, on behalf of her client, agreed to forward one-third of the $7,371.16 received to the investigator who uncovered the funds. A State of Michigan draft, in the amount of $7,371.17 made payable to the order of her client, was forwarded to respondent. Her client endorsed the check and the proceeds were deposited in respondent's personal account.

Respondent pled no contest to charges that she failed to deposit the funds into a trust account; failed to notify the investigator of the receipt of the funds; failed to deliver to the investigator the funds to which he was entitled; commingled the funds with her personal funds; and, failed to timely answer two requests for investigation.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); and Michigan Rules of Professional Conduct 1.15; 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law be suspended for a period of 30 days, and that she undergo a physical and mental examination which demonstrates that she is competent to practice law.

Costs were assessed in the amount of $719.46.
