NOTICE OF REPRIMAND (By Consent)
Case No. 93-95-GA Paul Moceri, P-39426, Farmington Hills, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #73.
1) Reprimand; 2) Effective November 5, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent pled nolo contendere to allegations that he continued to represent the plaintiff in a personal injury case after he discovered that the insurance carrier involved was a client of his law firm and although the insurance carrier's interests were directly adverse to those of his client; and failed to fully and adequately disclose the nature of the conflict of interest to his client for her consideration in determining whether to obtain other counsel.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); the Michigan Rules of Professional Conduct, 1.7; 1.9; and 8.4(a)and(c); and Canon 5 of the then-applicable Code of Professional Responsibility, DR 5-101(A)and(B) and DR 5-104(A).
Costs were assessed in the amount of $67.25.
