NOTICE OF SUSPENSION (By Consent)
Case No. 93-99-GA David P. Boekeloo, P-40876, Portage, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #28.
1) Suspension - 120 days; 2) Effective October 6, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was retained to represent a client in an insurance claim. He admitted that he failed to file a lawsuit or assert a claim on his client's behalf for a period of approximately 15 months; failed to keep his client or her representative reasonably informed concerning the status of the matter; knowingly made false statements to his client; and, failed to release his client's complete file upon request.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 1.15(b); 1.16(d); 3.2; 4.1; and 8.4(a)-(c).
Costs were assessed in the amount of $76.54.
