NOTICE OF REPRIMAND (By Consent)
Case No. 93-36-GA Clarice Y. Larkins, P-33415, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #24.
1) Reprimand; 2) Effective September 7, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent represented a defendant in a medical malpractice action. She pled nolo contendere to allegations that she: failed to file a timely answer to the first amended complaint; failed to timely file a witness list; failed to comply with the court's discovery orders; failed to notify her client of the trial date; failed to request that the individual defendants, including her client, be dismissed from the case after the plaintiff failed to produce any evidence of personal liability; failed to file any objections to the $86,275.09 judgment entered against her client individually; failed to advise her client of the adverse judgment against him; and, failed to keep her client reasonably informed concerning the status of the matter.
Respondent pled nolo contendere to charges that her conduct violated MCR 9.104(1)-(4); the Michigan Rules of Professional Conduct, 1.1(a)-(c); 1.3; 1.4; 3.2; and 8.4(a)and(c); and Canons 1, 6 and 7 of the then applicable Code of Professional Responsibility, DR 1-102(A)(1),(5)and(6); DR 6-101(A)(3); and DR 7-101(A)(1)-(3).
Costs were assessed in the amount of $154.00
