NOTICE OF SUSPENSION Case Nos. 93-98-GA; 93-138-FA Alexander Bensky, P-25084, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #4.

1) Suspension - 121 Days; 2) Effective October 30, 1993. Respondent failed to answer the formal complaints and failed to appear at the hearing held in Detroit on August 17, 1993. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaint.

Respondent was appointed to represent a defendant in two criminal appeals, but failed to file claims of appeal; failed to seek any post-conviction relief; failed to keep his client reasonably informed concerning the status of the matters; failed to supplement the record as ordered by the court regarding the defendant's allegations of ineffective assistance of counsel; and, failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 3.4(c); 8.1(b); and 8.4(a)and(c); and the Minimum Standards for Indigent Criminal Appellate Defense Services, Michigan Supreme Court Administrative Order 1981-7, Standards 1, 5, 7, 8, 9, 15 and 17.

Costs were assessed in the amount of $127.60.
