NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 93-22-GA Charles A. Anderson, P-30898, Kalamazoo, Michigan, by Attorney Discipline Board Kent County Hearing Panel #1.

1) Reprimand; 2) Effective August 3, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent was retained to represent clients in claims arising from injuries sustained as a result of a slip and fall accident, and filed an action on behalf of his clients . He pled nolo contendere to allegations that he failed to advise his clients of the dismissal of the case pursuant to the court's Order Granting Motion for Summary Disposition; failed to advise his clients that they had 15 days from the date of the court's Order Granting Summary Disposition to amend their complaint to set forth sufficient facts to present a cause of action; and, failed to respond to his clients' inquiries about the case or to keep them reasonably informed of the status of their matter.

Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; and 8.4(a)and(c); and Canons 1, 6 and 7 of the then- applicable Code of Professional Responsibility, DR 1-102(A)(1),(5) and(6); DR 6-101(A)(3); and DR 7-101(A)(3).

Respondent agreed to make restitution to the complainant in the amount of $3000.00. Costs were assessed in the amount of $97.69.
