NOTICE OF SUSPENSION Case No. 92-198-GA Michael J. Berezowsky, P22800, Farmington Hills, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #81.

1) Suspension - one year; 2) Effective July 29, 1993. Respondent was retained to institute divorce proceedings, and filed a complaint for divorce on his client's behalf. The court granted a judgment of divorce on the record, and three times notified respondent of its intent to dismiss the action for failure to submit a proposed judgment of divorce to the court. Respondent was later served with a proposed judgment of divorce under the provisions of MCR 2.602(B)(3), by the defendant.

The panel found that respondent failed to advise his client that the judgment of divorce had been entered by the court; and, failed to timely notify his client of his suspension from the practice of law effective February 4, 1992, and his inability to complete the divorce action or to file objections to the proposed order submitted by the defendant. The panel also found that respondent failed to timely answer an unrelated request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104 (1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); MCR 9.119(A); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 8.1(b); and 8.4(a)and(c).

Costs were assessed in the amount of $774.76. NOTE: Respondent's license to practice law in Michigan has been continuously suspended since February 4, 1992.
