1) Suspension - 180 days; 2) Effective August 7, 1993. Respondent was retained by the plaintiff(s) in connection with four separate racial discrimination actions. The panel found that the proofs established a lack of diligence and communication with his clients about the realities of their cases. The panel further found that, with respect to one of the discrimination cases, respondent failed to refund the unearned $5250 retainer fee and failed to release his client's file upon demand.
Respondent's conduct was found to be in violation of MCR 9.104 (1)-(4); and the Michigan Rules of Professional Conduct, 1.3; 1.4; 1.16(d); and 8.4(a)and(c).
In determining the level of discipline to be imposed, the panel considered the aggravating factor of respondent's prior disciplinary record, which includes two reprimands and a 60-day suspension.
Costs were assessed in the amount of $1615.01.
