NOTICE OF SUSPENSION WITH CONDITIONS Case No. 93-14-GA Richard G. Parchoc, P34727, Dearborn, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #59.

1) Suspension - 120 days; 2) Effective June 9, 1993. Respondent was retained to represent the plaintiff in civil litigation in Federal Court. The plaintiff subsequently died. Litigation was continued in the name of the plaintiff's estate through its personal representative, the deceased's wife. Respondent proceeded to represent the estate in the litigation.

The hearing panel found that respondent failed and neglected to file a substitution of parties subsequent to the plaintiff's death, resulting in dismissal of the case; failed and neglected to keep the deceased's wife and/or the estate representatives informed concerning the status of the matter, or to advised the deceased's wife that the case had been dismissed due to his failure to file a substitution of parties in the litigation; and, failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.103 (C); MCR 9.104(1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 8.1(b); 8.4(a)and(c).

The hearing panel ordered that respondent's license be suspended for 120 days effective June 9, 1993, the date of the final hearing in this matter. The panel also ordered that respondent make restitution to the complainant in the amount of $5000.00, and imposed additional conditions relevant to the established misconduct.

Costs were assessed in the amount of $789.04.
