NOTICE OF REPRIMAND (By Consent)
Case No. 92-133-GA Lawrence R. Greene, P14336, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #10.
1) Reprimand; 2) Effective June 26, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was retained to represent a client in a divorce matter. He admitted that he failed to appear for a pretrial conference which resulted in the entry of a default against his client; failed to advise his client of the default; failed to take action to have the default set aside; failed to enter into settlement negotiations on his client's behalf; failed to appear at a show cause proceeding at which his client was found in contempt of court for failure to pay certain bills as previously ordered by the court; failed to appear at a hearing on a motion to sell the marital home; failed to appear at a hearing on the entry of the judgment of divorce; failed to object to the entry of the judgment of divorce which awarded the main asset of the marital estate to his client's wife; and, failed to advise his client of the terms of the judgment of divorce. Respondent's conduct was admitted to be in violation of MCR 9.104(1-4); and the Michigan Rules of Professional Conduct, 1.1(a-c); 1.2(a); 1.3; 1.4; 8.4(a,c).
Respondent pled nolo contendere to the allegation that he knowingly made false statements in his answer to the request for investigation. Respondent's conduct was alleged to be in violation of MCR 9.104(1-4,6); MCR 9.113(A); and the Michigan Rules of Professional Conduct, 8.1(a); 8.4(a-c).
Costs were assessed in the amount of $76.85.
