NOTICE OF SUSPENSION AND RESTITUTION Case No. 93-35-GA Frank L. Gillespie, IV, P37513, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #13.
1) Suspension - 120 days; 2) Effective June 9, 1993. Respondent was retained in connection with a land contact foreclosure/forfeiture action, and received a $500 attorney fee to commence the action. He admitted that he failed to file an action for foreclosure/forfeiture or to obtain a resolution of the matter short of filing litigation; failed to adequately communicate with his client concerning the status of the matter; and, failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.104 (1)-(4)and(7); MCR 9.103(C); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; 8.1(b); and 8.4(a)and(c).
Respondent agreed to the 120-day suspension effective June 9, 1993, and agreed to make restitution to his client in the amount of $500. Costs were assessed in the amount of $157.09.
