NOTICE OF REPRIMAND (By Consent)
Case No. 92-313-GA Allan R. Gurvitz, P14470, Birmingham, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #64.
1) Reprimand; 2) Effective June 5, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was retained to prosecute a medical malpractice action. Respondent pled nolo contendere to charges that he failed to return his clients' telephone calls or communicate with them; failed to advise his clients of the existence of a two year statute of limitations for medical malpractice and/or the date the statute of limitations would expire; and falsely advised his clients that he had not been able to find a medical expert to support the case.
Respondent conduct was alleged to be in violation of MCR 9.104 (1-4); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a,b); 3.2; 8.4(a-c); and Canons 1, 6 and 7 of the then- applicable Code of Professional Responsibility, DR 1-102(A)(1,4-6); DR 6-101(A)(3); DR 7-101(A)(1-3). Costs were assessed in the amount of $52.05.
