NOTICE OF REVOCATION Case Nos. 92-232-GA; 92-249-FA William T. Spencer, P-26943, Detroit and Northville Township, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #18.

1) Revocation; 2) Effective April 1, 1993. Respondent failed to answer the formal complaints and failed to appear at the hearing held in Detroit on January 26, 1993. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaint.

Respondent was retained to prosecute a podiatric malpractice action, but failed to file affidavits of his expert witnesses; failed to depose one of the expert witnesses within the time frame established by the court; failed to locate the necessary expert witnesses and/or to conduct the necessary discovery; failed to keep his client reasonably informed concerning the status of the matter; and failed to answer the request for investigation.

Respondent was retained to prosecute a personal injury action, but failed to take any action of his client's behalf; failed to keep his client reasonably informed concerning the status of the matter; and failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(A)and(B)(2); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a); 3.2; 8.1(b); 8.4(a,c); and Canons 1, 6 and 7 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3). Costs were assessed in the amount of $160.24.

NOTE: Respondent's license to practice law in Michigan has been continuously suspended since February 28, 1992.
