NOTICE OF DISBARMENT (Pending Appeal)

Disbarment, Effective February 7,2019

Washtenaw County Hearing Panel #1 found that respondent misappropriated client funds and commingled them with his own, in violation of MRPC 1.15(b)(3) and (d); and MRPC 1.15A(a)(2). The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 45 days,e ffective July 12, 2016. Respondent did not petition for review, thus the suspension of his license to practice law became effective on July 12, 2016. Pursuant to MCR 9.123(A),r espondent's license to practice law in Michigan was automatically reinstated,e ffective August 31,2 016, with his 'filing of an af idavit of compliance with the Michigan Supreme Court,t he Attorney Discipline Board, and the Grievance Administrator.

The Grievance Administrator filed a petition for review,s eeking an increase in the discipline imposed. The Attorney Discipline Board conducted review proceedings in accordance with MCR 9.118 on October 19, 2016. The Board subsequently issued an order referring the matter to a master for additional proceedings. A hearing before the master was held on May 11,2 018 and the master's report was issued on August 15, 2018. The Board then conducted supplemental review proceedings on October 16, 2018. On January 9, 2019,t he Board issued an order increasing the discipline imposed from a 45 day suspension to disbarment,e ffective February 7,2 019, with credit for the 45-day period of suspension served between July 12,2 016, and August 30,2016.

On January 28, 2019, respondent filed an application for leave to appeal and a request for 7a stay of the effect r�eive date of the order of disbarment with the Michigan Supreme Court. Decisions th re uests ndi
