NOTICE OF REPRIMAND (By Consent)
Case No. 92-221-GA Harry S. Sherwin, P-20365, Flint, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #4.
1) Reprimand; 2) Effective May 18, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled nolo contendere to the charges of professional misconduct contained in count one of the Formal Complaint. Count Two was dismissed.
Respondent was retained by the plaintiff/wife to institute divorce proceedings, and instituted proceedings in the Genesee County Circuit Court. Proofs were placed on the record, and a judgment of divorce was entered and signed by the court. The formal complaint alleges that respondent failed to forward to his client a copy of the judgment of divorce for a period of five months; and, failed to respond to his client's inquiries concerning the status of the matter.
Respondent's conduct was alleged to be in violation of MCR 9.104(1-4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 8.4(a,c). Costs were assessed in the amount of $80.50.
