NOTICE OF SUSPENSION Case No. 92-79-GA Joseph Malfait, P31174, Port St. Lucie and Ft. Pierce, Florida (formerly of Port Huron, Michigan), by Attorney Discipline Board Tri-County Hearing Panel #108.
1) Suspension - 180 days; 2) Effective May 18, 1993. (To run consecutively to the three-year suspension imposed in ADB 176-89; 90-1-FA, which commenced on May 18, 1990.)
Respondent failed to answer the formal complaint and failed to appear at the hearing held in Mt. Clemens on May 6, 1992. The panel found that the allegations of misconduct contained in the formal complaint had been established by respondent's failure to answer, appear, or otherwise defend the charges.
Respondent failed to answer a request for investigation in violation of MCR 9.104(1-4,7); MCR 9.113(A)and(B)(2); and the Michigan Rules of Professional Conduct, 8.1(b); 8.4(a,c). Costs were assessed in the amount of $88.35.
NOTE: Respondent has been continuously suspended from the practice of law in Michigan since January 5, 1989.
