1) Suspension - 30 days; 2) Effective April 29, 1993; Respondent was retained by a woman to prepare her will, commence probate proceedings for her husband's estate, and commence guardianship proceeds on behalf of her minor daughter, and was paid a $350.00 retainer fee. Respondent pled nolo contendere to the charges that he failed to prepare a will on behalf of his client; failed to keep his client informed of the status of her matters, failed to return to her all the documentation that she had provided him, failed to inform her that he was terminating his association with his current law firm, and failed to advise his client where he could be reached in the future; and failed to answer the request for investigation.
Based on respondent's plea of nolo contendere, the panel found that respondent's conduct was in violation of MCR 9.104 (1-4,7); MCR 9.103(C); MCR 9.113(A)and(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.4(a); 3.2; 8.1(b); and 8.4(a,c). Costs were assessed in the amount of $149.72.
