NOTICE OF SUSPENSION (With Conditions)
Case Nos. 92-178-GA; 92-203-FA David M. Dean, P30903, Port Huron, Michigan, by Attorney Discipline Board St. Clair County Hearing Panel.
1) Suspension - 60 days; 2) Effective March 13, 1993. Respondent failed to timely answer the formal complaint, but appeared at the hearings held in Port Huron on September 15 and December 9, 1992. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaint.
Respondent purchased cocaine, or provided funds to another person who would purchase it on his behalf; pled guilty to using cocaine; and made a false statement in his answer to the request for investigation.
Respondent's conduct was found to be in violation of MCL 333.7403(2)(a)(iv); MCR 9.104(1-7); MCR 9.119(A); and the Michigan Rules of Professional Conduct, 8.1(a); 8.4(a-c). The hearing panel ordered that respondent's license to practice law be suspended for a period of 60 days, with additional conditions relevant to the established misconduct. Costs were assessed in the amount of $479.90.
