NOTICE OF SUSPENSION Case No. 91-28-GA William L. Fischel, P-22866, Farmington Hills, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - 45 days; 2) Effective February 26, 1993. Respondent was retained to prosecute a wrongful discharge matter and filed suit on behalf of his client. An order of dismissal was subsequently entered. Respondent did not appeal the order of dismissal. The hearing panel found that respondent misrepresented the status of the matter to his client, assuring his client that the case was still pending and the order of dismissal had been appealed.

Respondent's conduct was found to be in violation of MCR 9.104; and Canon 1 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,4-6). On May 28, 1992, Tri-County Hearing Panel #70 entered an order suspending respondent's license for a period of 45 days.

Respondent filed a petition for review and automatic stay of discipline. on September 25, 1992, the Attorney Discipline Board entered an order affirming the hearing panel order of suspension.

Respondent filed an application for leave to appeal with the Michigan Supreme Court. On February 26, 1993, the Supreme Court entered an order denying respondent's application for leave to appeal. The suspension is deemed to be effective on that date.

Cost were assessed in the amount of $998.43.
