NOTICE OF REVOCATION BY RESIGNATION PURSUANT TO MCR 9.115(M)

Case No. 92-89-GA Wilfred C. Rice, P-19411, Litchfield, Michigan, by Attorney Discipline Board Washtenaw County Hearing Panel #2.

1) Revocation; 2) Effective January 20, 1993. The hearing panel found that certain allegations of professional misconduct contained in the formal complaint were established by a preponderance of the evidence, as reflected in the panel's report on misconduct. In lieu of further proceedings, the parties filed a Stipulation for Resignation and Order of Revocation pursuant to MCR 9.115(M).

Respondent was suspended from the practice of law in Michigan for a period of 180 days effective November 2, 1991. (See Notice of Suspension dated November 21, 1991.) In violation of that order of suspension, respondent continued to practice law while suspended; failed to notify all of his active clients of the suspension; failed to file a notice of disqualification with the appropriate tribunals and all parties in which he was representing a client; and failed to file an affidavit of compliance pursuant to MCR 9.119.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,9); MCR 9.119(A-E); and the Michigan Rules of Professional Conduct, 1.4; 1.16(a); 8.4(a-c). Costs were assessed in the amount of $519.82.
