NOTICE OF REPRIMAND (By Consent)
Case No. 92-75-GA Ellen C. Wallaert, P21936, Eastpointe, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #104.
1) Reprimand; 2) Effective March 4, 1993. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled no contest to the allegations of professional misconduct contained in Count One of the Formal Complaint; and as to Count Two of the Formal Complaint, respondent pled no contest to negligent misrepresentation.
Respondent was appointed to represent a defendant in a criminal appeal. The complaint alleged that she failed to file a claim of appeal; failed to keep her client reasonably informed; and made a false statement in her answer to the request for investigation.
Respondent's conduct was alleged to be in violation of MCR 9.104(1-4); MCR 9.113(A); the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 3.2; 8.1(a); 8.4(a,c); and Canons 1, 6 and 7 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3). Costs were assessed in the amount of $91.97.
