1) Suspension - three years; 2) Effective December 11, 1992. Respondent failed to answer Formal Complaint 92-213-GA and failed to appear at the hearing held in Troy on October 16, 1992. Respondent's default was entered, and the panel determined that the default established the allegations of that formal complaint. Formal Complaint 92-241-FA was dismissed on the petitioner's motion.
Respondent was suspended from the practice of law in Michigan for a period of 180 days effective May 12, 1990 (see Notice of Suspension and Restitution dated May 18, 1990); he remained under suspension at the time Formal Complaint 92-213-GA was filed. Respondent practiced law while suspended; failed to notify his clients, the tribunals and opposing counsel of his suspension; failed to file an affidavit of compliance concerning his order of suspension; failed to pay disciplinary costs; and failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7,9); MCR 9.103(C); MCR 9.113(A)and(B)(2); MCR 9.119; MCL 600.916; MSA 27A.916; and the michigan Rules of Professional Conduct, 5.5(a); 8.1(b); 8.4(a-c). Costs were assessed in the amount of $104.92.
