NOTICE OF REVOCATION AND RESTITUTION Case Nos. ADB 64-88; 106-88 Arthur Allan Smith, P20621, Dearborn, Michigan, by the Attorney Discipline Board affirming a hearing panel Order of Revocation and Restitution.

1) Revocation; 2) Effective February 3, 1993. The panel found that respondent's handling of three decedent's estates involved multiple acts of neglect, misrepresentation, commingling and misappropriation of client funds. Respondent also failed to answer a request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4); MCR 9.103(C); MCR 9.113(B)(2); and Canons 1 and 9 of the then-applicable Code of Professional Responsibility, DR 1-102(A) (1,3-6); DR 6-101(A)(3); DR 7-101(A)(1-3); DR 9-102(A); DR 9-102 (B)(2-4).

The panel ordered that respondent's license to practice law in Michigan be revoked effective February 3, 1993, and that he make restitution to the aggrieved parties in the total amount of $39,863.70.

Respondent filed a petition for review asking that the hearing panel Order of Revocation and Restitution be vacated. On June 22, 1993, the Attorney Discipline Board affirmed the hearing panel Order of Revocation. Costs were assessed in the amount of $2736.17.

NOTE: Respondent was also suspended for a period of 120 days in Case No. 91-49-GA, effective March 6, 1993. See notice dated March 10, 1993.
