NOTICE OF REPRIMAND Case No. 91-185-GA Gary D. Hunley, P 30132, Taylor, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #27.

1) Reprimand; 2) Effective December 5, 1992. The hearing panel found that the allegations of professional misconduct contained in Count one, paragraph E(i), and Count Three of the Formal Complaint were established by a preponderance of the evidence. Count One, paragraph E(ii), and Count Two were dismissed.

Respondent was retained to institute a bankruptcy proceeding, accepted $500.00 as he fee for the representation, and instituted bankruptcy proceedings, but failed to appear for his client's section 341 bankruptcy hearing forcing the trustee to appoint a lawyer unknown to the client to represent her interests; and made a misleading and/or false statements in his answer to the request for investigation and in response to further correspondence from the Attorney Grievance Commission.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4, 6); MCR 9.113(A); and the Michigan Rules of Professional Conduct, 1.1 (c); 1.3; 8.4(a-c). Costs were assessed in the amount of $649.75.
