NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

Case No. 92-46-GA Carl E. Beltz, Jr., P10667, Mt. Clemens, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #101.

1) Reprimand; 2) Effective December 8, 1992. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5), which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled nolo contendere to the allegations of professional misconduct contained in the formal complaint.

Respondent was retained to assist a client in obtaining child support from his ex-wife for support of their two children. The complaint alleged that respondent failed to investigate the status of his client's ex-wife's employment for purposes of determining an appropriate amount of child support, or to file a motion on his client's behalf seeking child support; failed to maintain adequate communication with his client and failed to inform him that he had not taken any action on his behalf; and, made false representations to his client regarding the status of the child support matter.

Respondent's conduct was alleged to be in violation of MCR 9.104(1-4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.4(a); 3.2; 8.4(a-c).

Respondent agreed to make restitution to his client in the amount of $150.00.Costs were assessed in the amount of $61.36.
