NOTICE OF SUSPENSION Case No. 92-162-GA Michael J. Berezowsky, P-22800, Farmington Hills, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #52.

1) Suspension - 120 days; 2) Effective October 16, 1992. The hearing panel found that respondent was retained by the defendant in a pending paternity action and filed a Motion to Modify the Order of Filiation, but failed to prosecute the Motion to Modify Order of Filiation and failed to keep his client reasonably informed concerning the status of the matter. The panel also found that respondent failed to answer two requests for investigation.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7); MCR 9.113(A)and(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 8.1(b); 8.4(a,c). The hearing panel ordered that respondent's license to practice law in Michigan be suspended for a period of 120 days effective October 16, 1992, to run concurrently with the three-year suspension imposed in Case No. 92-179-GA. Costs were assessed in the amount of $977.86.

NOTE: Respondent's license to practice law in Michigan has been continuously suspended since February 4, 1992.
