NOTICE OF SUSPENSION (With Conditions)

Case No. 92-179-GA Michael J. Berezowsky, P22800, Farmington Hills, Michigan by Attorney Discipline Board Tri-County Hearing Panel #61.

1) Suspension - three (3) years; 2) Effective October 16, 1992. The hearing panel found that the allegations of professional misconduct contained in the formal complaint were established by the respondent's admissions.

Respondent was assigned by the Michigan Assigned Appellate Counsel System to represent eight defendants in criminal appeals, but failed to file any pleadings on behalf of the defendants or take any other appellate action on behalf of his clients in violation of MCR 9.104(1-4); the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 3.2; 8.4(a,c); and Canons 1, 6 and 7 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1,3).

On November 9, 1992, Tri-County Hearing Panel #61 entered an order suspending respondent's license to practice law in michigan for a period of three years, retroactive to October 16, 1992, the date of the disciplinary hearing. The panel also ordered that respondent comply with certain conditions. Costs were assessed in the amount of $281.31.
