NOTICE OF REPRIMAND (By Consent)

Case No. 92-95-GA Roger A. Bird, P24800, Sturgis, Michigan, by Attorney Discipline Board Calhoun CoUnty Hearing Panel.

1) Reprimand; 2) Effective October 14, 1992. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5), which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled nolo contendere to the allegations contained in Count One of the formal complaint and pled nolo contendere that his conduct violated MCR 9.104(1) and MRPC 8.4(c). The balance of Count One, that respondent's conduct violated MCR 9.104(2-4) and MRPC 8.4(a,b), was dismissed. Count Two was also dismissed.

Respondent was retained to represent the plaintiff/wife in a divorce action. The complaint alleged that, while representing this client in the divorce action, respondent knew that he and/or his law firm was representing, or had represented, the judge assigned to preside over the divorce matter and/or the judge's wife in personal and business matters; and, knowing such, respondent failed to make a disclosure of this relationship to the opposing party for their knowledge and/or consideration in bringing any appropriate objections or motions based on the information. Costs were assessed in the amount of $5.50.
