1) Reprimand; 2) Effective October 14, 1992. The hearing panel found that the allegations of professional misconduct contained in counts one, two and four of Formal Complaint 91-149-GA were established by a preponderance of the evidence. Count three of Formal Complaint 91-149-GA and Formal Complaint 91-168-FA were dismissed.
Respondent was retained to file a landlord/tenant action, but failed to serve the complaint on the defendants, causing the case to be dismissed; failed to keep her client informed concerning the status of the case; and failed to respond to correspondence from the Attorney Grievance Commission. Respondent failed to answer an unrelated request for investigation.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7); MCR 9.113(A)and(B)(2); Canons 1, 6 and 7 of the then- applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1- 3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 8.1(b); 8.4(a,c). Costs were assessed in the amount of $900.65.
