NOTICE OF SUSPENSION Case No. 91-237-GA Frederick A. Sauer, Jr., P-19906, Kalamazoo, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - 30 days; 2) Effective October 8, 1992. In October, 1989, while his license to practice law was suspended, respondent instituted legal proceedings in his own name based upon a statement for services rendered by his professional corporation, failed to disclose to the court that the professional corporation was the owner of the accounts receivable. During the period of his suspension, respondent continued to attempt to collect other accounts receivable on behalf of the professional corporation; and sought and obtained a subpoena from the court to obtain records relating to the defendant three months after the case had been dismissed.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,9); MCR 9.119(E)(1,2); MCR 600.916; MCR 27A.916; and the Michigan Rules of Professional Conduct, 3.3(a)(1); 8.4(a-c).

Kalamazoo County Hearing Panel #1 ordered that respondent's license be suspended for a period of 30 days effective October 8, 1992. [See Notice of Suspension (Pending Appeal) dated October 14, 1992.] Costs were assessed in the amount of $630.92.

The Grievance Administrator filed a petition for review seeking an increase in the discipline imposed. In an order entered December 22, 1992, the Attorney Discipline Board affirmed the hearing panel order of suspension.

NOTE: Respondent's license was automatically reinstated pursuant to MCR 9.123(A) effective November 18, 1992. [See Notice of Automatic Reinstatement (Pending Appeal) dated November 20, 1992.]
