1) Reprimand; 2) Effective November 12, 1992. The hearing panel found that the allegations of professional misconduct contained in Count One of the formal complaint were established by a preponderance of the evidence. Count Two was dismissed.
Respondent was retained to assist a client in the probate of an estate, but prepared, filed and executed a Petition for Commencement of Proceedings which listed his client as sole heir when he knew or should have known that there were other heirs and/ or parties interested in the estate.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4); and Canon 1 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,4-6). Costs were assessed in the amount of $1047.00.
