NOTICE OF REPRIMAND Case No. 91-91-GA; 91-108-FA Lawrence A. Baumgartner, P25163, Mount Clemens, Michigan, by the Attorney Discipline Board reducing a hearing panel order of suspension for 30 days.
1) Reprimand; 2) Effective August 12, 1992. The hearing panel found misconduct was established as to paragraph D(i) and(iii) of Count One, and Count Three of Formal Complaint 91-91-GA, and as to Formal Complaint 91-108-FA. On review, the Attorney Discipline Board dismissed the allegations of misconduct in Count One of Formal Complaint 91-91-GA.
Respondent failed to answer a request for investigation; failed to timely answer Formal Complaint 91-91-GA; and failed to answer Formal Complaint 91-108-FA. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103 (C); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 8.1(b); 8.4(a,c).
On November 12, 1991, Tri-County Hearing Panel #104 entered an order suspending respondent's license to practice law for 30 days. Respondent filed a petition for review seeking a decrease in the discipline imposed. On July 21, 1992, the Attorney Discipline Board entered an order reducing discipline to a reprimand. Costs were assessed in the amount of $359.23.
