1) Reprimand; 2) Effective August 26, 1992. Based upon the evidence presented, the hearing panel concluded that the respondent was retained in August 1983 to represent a client in an appeal in a civil case but that he failed to file a timely appellate brief and failed to file a response to the motion to dismiss filed by the opposing party.
The panel concluded that this inaction constituted violations of Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(5); DR 6-101(A)(3) and DR 7-101(A)(2,3).
The hearing panel considered the respondent's prior unblemished record in reaching its conclusion that a reprimand should be imposed. Costs were assessed in the amount of $1262.70.
