NOTICE OF SUSPENSION (With Conditions)

Case No. 92-309-JC Barry P. Boyer, P-29940, Mt. Clemens, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #107.

1) Suspension - 25 months; 2) Effective May 14, 1992. Respondent pled guilty on May 14, 1992, in the 10th Circuit Court, Saginaw County, to one count of Unlawful Driving Away a Motor Vehicle in violation of MCL 750.413, a felony. In accordance with MCR 9.120(B)(1), respondent's license to practice law in Michigan was automatically suspended effective May 14, 1992, the date of the felony conviction.

Upon the filing of the Judgment of Conviction, the Attorney Discipline Board entered an order directing the respondent to show cause why a final order of discipline should not be entered.

Following a hearing held in accordance with MCR 9.120(B)(3), Tri-County Hearing Panel #107 entered an order suspending respondent's license to practice law in Michigan for 25 months effective May 14, 1992, conditioned on his successful completion of an inpatient alcohol abuse program at the Veterans Administration facility during the suspension period, and continuance and verification of his attendance at Alcoholics Anonymous meetings throughout the suspension period.

Costs were assessed in the amount of $367.78.
