NOTICE OF REPRIMAND (By Consent)
Case No. 91-223-GA Timothy P. Murphy, P25941, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #30.
1) Reprimand; 2) Effective July 1, 1992. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. Respondent admitted the allegations contained in Count One of the formal complaint. Counts Two and Three were dismissed by stipulation.
Respondent was retained to represent the defendant at a sentencing hearing on a guilty plea to operating a motor vehicle while visibly impaired. Respondent filed a motion to dismiss which was denied. Respondent stated on the record that the Court's refusal to dismiss the case would be appealed.
In violation of his duties to hie client, respondent failed to file an appeal or to take any other action to preserve his client's appellate rights.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4); and Canons 1, 6 and 7 of the then-applicable Code of Professional Responsibility, DR 1-102 (A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3). Costs were assessed in the amount of $667.79.
