1) Reprimand; 2) Effective July 23, 1992. The hearing panel found that the allegations of misconduct contained in Count I(c)(i) and Count II were established by a preponderance of the evidence. Count I(C)(ii) was dismissed.
Respondent was retained to represent a woman in a child custody matter pending before the Wayne County Circuit Court, but failed and/or refused to have an order entered with the court, effectuating a favorable ruling by the Friend of the Court, because his client had given him a check which had been dishonored for insufficient funds; and failed and/or refused to return to his client the original financial documents which she had provided him for use in his representation of her.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.15(a,b); 8.4 (a,c). Costs were assessed in the amount of $863.92.
