NOTICE OF REPRIMAND (By Consent)
Case No. 92-74-GA Ray Gennick, P32230, Mt. Clemens, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #106.
1) Reprimand; 2) Effective June 24, 1992. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled guilty to the allegations contained in the formal complaint.
Respondent was appointed through the Michigan Appellate Assigned Counsel System to represent a defendant concerning the appeal of his conviction. Respondent failed to timely file an appellate brief on his client's behalf; failed to send his client a copy of the Court of Appeals Order affirming his conviction; and failed to advise his client of the time limitations in which to file for leave to appeal with the Michigan Supreme Court.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a); 3.2; 8.4(a,c). Costs were assessed in the amount of $5.52.
