NOTICE OF SUSPENSION ADB 117-89; 141-89 Marc R. Lakin, P41147, Detroit, Michigan by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - thirty (30) days; 2) Effective November 29, 1991. The hearing panel found that the allegations of count two of the formal complaint were established by the respondent's admissions. Count one was dismissed. Respondent failed to answer a request for investigation in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and Canon 1 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6). On May 7, 1990, the panel entered its order suspending respondent's license to practice law in Michigan for a period of thirty days.

Respondent filed a petition for review seeking a reduction of the discipline imposed. In an order dated October 9, 1990, the Attorney Discipline Board affirmed the hearing panel order. Respondent filed a motion for reconsideration which was denied in an order entered February 25, 1991. Respondent filed an application for leave to appeal with the Michigan Supreme Court which was denied in an order entered November 8, 1991. On November 14, 1991, the Michigan Supreme Court entered an order amending its order of November 8, 1991, and respondent's suspension is deemed to be effective November 29, 1991. Costs were assessed in the amount of $881.10.
