NOTICE OF SUSPENSION Case Nos. 91-57-GA; 91-85-FA Edward N. Rapoport, P36698, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #52.

1) Suspension - one (1) year; 2) Effective December 23, 1991. Respondent failed to answer the formal complaint and failed to appear at the hearing held in Birmingham on May 31, 1991. Respondent's default was entered and the panel determined that the default established the allegations of formal complaint 91-57-GA. Formal complaint 91-85-FA was dismissed without prejudice. Respondent was retained to institute divorce proceedings and filed a complaint for divorce, but failed to prosecute the divorce, failed to keep his client informed concerning the status of the matter, and failed to answer the request for investigation. Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(b,c); 1.3; 1.4(a,b); 8.1(b); 8.4(a,c). The hearing panel ordered that the one year suspension in this matter run consecutively to a prior six-month suspension, (Case Nos. 91-15-GA; 91-36-FA), which became effective on June 22, 1991. Costs were assessed in the amount of $121.08.
