NOTICE OF REPRIMAND WITH CONDITIONS Case No. 91-126-GA Walter A. Lucken, P23178, Mount Clemens, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #102.

1) Reprimand; 2) Effective December 19, 1991. The hearing panel found that misconduct as to count one and count three(C)(i) was established by a preponderance of the evidence. Counts two, three(c)(ii) and four were dismissed. Respondent was retained to prosecute a wrongful death action, but abandoned his client's cause of action without his client's knowledge or consent and failed to timely inform his client that the case had been dismissed. Respondent's conduct was found to be in violation of MCR 9.104(1-4); Canons 1, 6 and 7 of the then- applicable Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.4(a); 8.4(a-c). The panel ordered respondent to take a law office management course. Costs were assessed in the amount of $522.39.
