1) Reprimand; 2) Effective December 19, 1991. The hearing panel found that misconduct was established by a preponderance of the evidence. Respondent was retained to represent an individual in a criminal matter, accepted a $415.00 retainer and filed an appearance, but failed to appear for his client's plea hearing; failed to appear for his client's sentencing hearing; and advised the court that he would not represent the client even though he had not been released from representation by his client or the court. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and the Michigan Rules of Professional Conduct, 1.1(c); 1.2; 1.3; 1.16(b); 8.4(a,c)- The panel ordered respondent to make restitution to the client in the amount of $415.00. Costs were assessed in the amount of $229.79.
