NOTICE OF REPRIMAND (By Consent)
Case No. 90-159-GA K. Alexander, P10096, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #59.
1) Reprimand; 2) Effective November 14, 1991. The Attorney Grievance Commission and a hearing panel approved a stipulation for consent order of discipline containing the respondent's plea of nolo contendere to the allegations in the formal complaint. The complaint charged that the respondent violated his duties to a client by preparing a power of attorney naming himself and his step-father as attorneys-in-fact and by causing the client to execute a quit-claim deed transferring ownership of certain real property to the respondent's mother. The respondent's conduct was alleged to be In violation of MCR 9.104 (1-4); Canons 1, 5, 6 and 7 of the Code of Professional Responsibility, DR 1-102 (A)(1,4-6); DR 5-101(A); DR 6-101(A)(3); DR 7-101(A)(3); and the Michigan Rules of Professional Conduct, 1.8(b); 8.4(a-c). During the proceedings before the panel, the respondent offered in his defense that the client named in the complaint was a relative and that the documents in question were drafted as an accommodation to all of the family members involved. Costs were assessed in the amount of $333.21.
NOTE: The complainant filed a petition for review seeking restitution of $4000.00. In an order dated April 16, 1992, the Attorney Discipline Board affirmed the order of Reprimand (By Consent) and denied the complainant's request for restitution.
