NOTICE OF SUSPENSION (By Consent)
Case No. 91-132-GA Dean S. Jennings, P15491, St. Joseph, Michigan, by Attorney Discipline Board Kalamazoo County Hearing Panel #2.
1) Suspension - 120 days; 2) Effective January 31, 1992. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pled no contest to certain allegations contained in counts one and three of the formal complaint. Count two was dismissed by stipulation.
Respondent pled no contest to the charges that, while acting as attorney and personal representative of an estate, he took an attorney fee without the prior approval of the probate court and failed to complete the probate estate in a timely and expeditious manner.
Respondent's conduct was alleged to be in violation of MCR 9.104(1-4); the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.15(a,b); 8.4(a-c); and Canons 1, 6, 7 and 9 of the then-applicable Code of Professional Responsibility, DR 1-102(A) (1,3-6); DR 6-101(A)(3); DR 7-101(A)(1-3); DR 9-102(A); DR 9-102 (B)(4). Costs were assessed in the amount of $511.32.
