NOTICE OF REVOCATION Case Nos. 91-58-GA; 91-82-FA Jeffrey S. Fishman, P32798, Chicago, Illinois (formerly of Birmingham, Michigan), by Attorney Discipline Board Tri-County Hearing Panel #53.

1) Revocation; 2) Effective November 9, 1991. Respondent failed to answer the formal complaints and failed to appear at the hearings held in Troy on May 30, 1991 and August 22, 1991. Respondent's defaults were entered and the panel determined that the defaults established the allegations of the formal complaints.

While suspended from the practice of law for non-payment of bar dues and disciplinary costs, respondent continued to hold himself out as an attorney and practiced law while suspended. Respondent filed a false affidavit with the Michigan Supreme Court indicating that he had fully complied with the terms of the suspensions, continued to communicate to the opposing client although advised that she was represented by counsel, allowed the balance of his client trust account to fall below the amount owed to a client, and misappropriated $4000.00 from a client.

Respondent's conduct was found to be in violation of MCR 9.104 (1-5, 7-9); MCR 9.119; MCR 9.123(A); the Michigan Rules of Professional Conduct 1.15(a-c); 4.2; 8.4(a-c); and Canons 1 and 9 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,3-6); DR 9-102(A); DR 9-102(B)(4). Costs were assessed in the amount of $600.62.
