1) Suspension - 120 days; 2) Effective October 2, 1991. Respondent failed to answer the formal complaints, but appeared at the hearing held in Detroit on May 21, 1991. Respondent's defaults were entered and the panel determined that the defaults established the allegations of the formal complaints. Respondent was retained to institute a civil action and paid a total of $492.00, but failed to institute any proceedings on his client's behalf and failed to return the unused attorney fees for services not rendered. Respondent's conduct was found to be in violation of MCR 9.104(1,2,4,7) and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.15(a,b); 1.16(a)(1); 1.16(d); 3.2; 8.4(a-c). The panel ordered respondent to make restitution to his client in the amount of $492.00. Costs were assessed in the amount of $152.33.
