NOTICE OF REVOCATION (By Consent)
Case No. 91-192-GA David S. Molitz, P17881, San Diego, California, by Attorney Discipline Board Tri-County Hearing Panel #14.
1) Revocation; 2) Effective November 4, 1991. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline which was approved by the hearing panel and the Attorney Grievance Commission. Respondent admitted the charges of professional misconduct contained in the formal complaint.
Respondent was retained by the administratrix of an estate to serve as her attorney and was designated trustee of the family trust, but failed to promptly pay or deliver to the beneficiaries funds to which they were entitled and engaged in unauthorized borrowing of trust funds.
Respondent's conduct was alleged to be in violation of MCR 9.104(1-4) and Canons 1 and 9 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1,3-6); DR 9-102(B)(4). Costs were assessed in the amount of $147.28.
